6. Intellectual Property

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.3 Limitation of Liability

To the maximum extent permitted by law, LexAI Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

Our total liability for any claims arising from or related to our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless LexAI Solutions and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Documents or content you upload or process through our services

11. Termination

Either party may terminate these Terms at any time:

• By You: You may stop using our services and delete your account at any time
• By Us: We may suspend or terminate your access to our services immediately if you breach these Terms or for any other reason with reasonable notice

Upon termination, your right to use our services will immediately cease. Provisions that by their nature should survive termination (including ownership, disclaimers, indemnification, and limitations of liability) shall survive.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to conflict of law provisions.

Any disputes arising from or related to these Terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Tallinn, Estonia.

If you are a consumer residing in the EU, you also have the right to bring proceedings in the courts of your country of residence.

13. EU AI Act Compliance

Our services are designed to comply with the European Union's Artificial Intelligence Act. Our AI systems are classified as minimal risk and include:

• Transparency and explainability features
• Human oversight capabilities
• Accuracy and robustness measures
• Comprehensive documentation and audit trails

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after such changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and LexAI Solutions regarding your use of our services and supersede all prior agreements and understandings.
